Terms & Conditions



1.1 On payment of the deposit, you agree to be bound by this agreement to purchase your selected PV Solar System and accept these terms and conditions.
1.2 Solar Partners Australia reserves the right to terminate this agreement at any time and without penalty if at Solar Partners Australia’s sole discretion, determines that the installation or service cannot be effectively completed due to factors including but not limited to safety, building condition including switchboard suitability, or product availability.

1.3 Upon receipt of deposit Solar Partners Australia will complete all necessary applications, order all necessary equipment and schedule approximate installation dates to complete the installation of your solar PV Solar System for the quoted price if :
1.3.1 You are eligible for Solar Credits.

1.3.2 All required information for Solar Credits and network connection are provided to Solar Partners Australia

1.3.3 You agree to sign the Solar Credits forms when requested in a timely manner either on the day of installation or return by email with 48 hours of receipt of said solar credit forms.
1.3.4 Your meter box, switchboard and or sub-boards comply with Electrical Safety regulations, are in good condition and have sufficient space to install additional electrical equipment including metering.


2.1 You warrant you are the property owner and authorise Solar Partners Australia to install the system selected at your property.
2.2. You authorise Solar Partners Australia (its contractors, employees and installers) to have access to the property at times it reasonably requires.

2.3 You will co-operate fully and provide sufficient access to enable site inspections/installation and or removal of system.

2.4 You are responsible for all local government or planning requirements for the installation and operation of your system. You warrant that you have obtained all consents and approvals required to install your system at your premises. You also agree that Solar Partners Australia will not be responsible for any breach of local government regulations or laws.


3.1 Solar Partners Australia will install the system quoted in a tradesman like manner and be bound by the terms of this agreement
3.2 All products are subject to availability. Solar Partners Australia reserves the right to substitute products , provided the quality is equal to or greater than the product specified.


4.1 Ownership of the system and its associated components will pass to you after :
4.1.1 payment in full to Solar Partners Australia plus
4.1.2 All documentation or any actions required under this agreement have been executed in full.
4.1.3 The ownership and insurance risk of the PV solar system passes to you upon installation at your stated address. Solar Partners Australia suggests you check with your insurance company as to their requirements to ensure adequate coverage of your PV solar system.


5.1 A deposit of 10% of the out of pocket expenses is due upon acceptance of the offer.
5.2 Solar Partners Australia will hold the deposit subject to the terms and conditions set out in this contract.
5.3 If the agreement is terminated as a result of your default, your deposit paid will be forfeited to Solar Partners Australia.
5.4 The balance of the amount payable ( less deposit ) must be paid on or before the day of installation of the PV solar 
system at your property.

5.5 Solar Partners Australia will receive funds from Solar Credits as part payment for your system. The Solar Credits will be paid directly to Solar Partners Australia. If the Clean Energy regulator determines you are not eligible for Solar Credits, and consequently Solar Partners Australia is unable to receive the Solar Credits as part payment, you will be liable to Solar Partners Australia for the dollar value of the Solar Credits. If you are not eligible for Solar Credits or do not wish to access the Solar Credits incentive (i.e. you want to keep your STCs) the balance of the system cost is due on or before the day of installation.


6.1 Solar partners Australia does not guarantee you will receive any grant, rebate or incentive.
6.2 You duly authorise Solar partners Australia to sign and apply for STC`S credits. Solar partners Australia will receive the full benefit of any STC credits applicable to the system installed .
6.3 Solar partners Australia, its employees, agents or contractors do not accept any responsibility for administering or the outcome of any rebate application by the owner.
6.4 Solar partners Australia has no responsibility if you are ever required to repay part or all of the STC`s to government authorities.
6.5 The STC value is based on current prices being offered for STC`S at current market rates at the time of the preparation of your quotation. If the installation is delayed by more than 21 days after acceptance of the quotation the STC price may be subject to change between acceptance and final installation.
6.6 If STC price decreases by 5% or more then both parties must agree to postpone installation or revise STC value.


7.1 Solar Partners may terminate this agreement if either party breaches the terms of this agreement.
7.2 You may terminate this agreement if your system is not installed at your property within 120 days after the date of acceptance, provided delay is within Solar Partners Australia`s control.
7.3 If Solar Partners Australia terminates this agreement you will be notified in writing, your deposit will be refunded in full with 14 days of notification.


8.1 If you fail to pay any amount that is payable under this agreement, Solar Partners Australia will be entitled to interest on the unpaid amount.
8.2 Interest will be accrued at the rate applicable to judgement debts in the supreme court in the state or territory that your property is located.

8.3 You agree to pay Solar Partners Australia any costs associated with recovery outstanding debt.


9.1 Solar Partners Australia warrants that the installer of your system is suitably qualified, experienced and possesses any licenses required under Australian law.
9.2 Solar Partners Australia will repair any damage to your property that is caused during the installation of your system unless the damage is caused or contributed to by a pre-existing condition. This includes old or brittle roof tiles, the roof structure and or electrical wiring provided you notify Solar Partners Australia within 90 days of installation.
9.3 Products installed by Solar Partners Australia are warranted by their respective manufacturers and distributors. These warranties are provided at installation and are also available by request.
9.4 Solar Partners Australia will endeavour to connect the system to the available wifi network. If the network is not available, a suitable arrangement for system communications and monitoring must be made available. Solar Partners Australia will provide a quote to complete this work.
9.5 Solar Partners Australia guarantees the operation and performance of the System, will be free from fault or defect for a period of 10 years commencing on the date the System is installed and we will repair any such default or defect notified to us within the Guarantee Period.
9.6 The guarantee in clause 9.5 will not apply where:
– the fault or defect is not notified to us within the Guarantee Period; or
– the fault or defect is a result of:

– something is done by you or someone else, and not us or our contractors;
– something beyond human control that occurred after installation, e.g., an extreme weather event;
– the System being misused, abused, neglected or damaged after installation;
– the System being maintained other than in accordance with the Maintenance Documents; or
– the System being repaired, modified, reinstalled or repositioned by anyone other than a service technician approved by us in writing.
– the fault is the result of an isolator switch failure or other consumable components.
9.7 Some Manufacturer guarantees do not include labour, travel and delivery costs. We will notify you if this is the case, and tell you the costs payable. The costs will be payable in advance.


10.1 Solar Partners Australia warrants that system will be installed in a position that is likely to maximise system performance unless alternative positioning is requested by you.
10.3. Solar Partners Australia does not guarantee any particular level of performance of the PV Solar system and accepts no responsibility if performance is lower than anticipated. The performance is subject to a number of local factors including the roof orientation and pitch, the number of hours of direct sunlight, cloud cover and shading from building structures and trees, some of which will change over time. This does not diminish Solar Partners Australia or the manufacturer’s warranties in relation to the system and its components.


11.1 Solar Partners Australia does not make any representations or warranties to you in connection with any system or their installation except for those warranties set out in this agreement and those warranties that cannot be excluded from this agreement.
11.2 To the extent permitted by law, Solar Partners Australia`s liability for breach of any express or implied condition or warranty is limited to the repair or replacement of the relevant system.

11.3 To the maximum extent permitted by law, Solar Partners Australia has no liability to you for breach of this agreement other than as to set out in the preceding paragraph. Solar Partners Australia has no liability to pay any damages or compensation for breach of this agreement.


12.1 You agree to provide Solar Partners Australia with whatever personal information it may require from you to supply goods and services under this agreement. In particular for the accurate completion of the paperwork for the Solar Credits incentive (selling of your STCs) and network connection to the grid.
12.2. Solar Partners Australia will provide your information to its contractors, employees, installers and if required debt collection agencies only so far as to effectively perform their role.

12.3 Solar Partners Australia will provide your information on your behalf to the relevant bodies for the processing of the Solar Credits incentive (selling of your STCs), connecting your PV Solar system to the grid and if asked your electricity retailer.
12.4 Unless otherwise agreed with you, Solar Partners Australia will not provide your personal information to any third parties other than those mentioned above.

12.5 Solar Partners Australia will not sell your personal information in any circumstances.
12.6 By accepting this agreement you consent to Solar Partners Australia collecting, using and disclosing your information as set out in this agreement.


13.1 This agreement sets out the entire agreement between you and Solar Partners Australia

13.2 This agreement is governed by the laws of the state in which your property is located.

13.3 Any reference to Solar Partners Australia includes a reference to its employees, servants, agents, installers, contractors and sub-contractors.
